For instance, landlords can reduce their taxes by way of depreciation, and they can offset salary income with losses.  In addition, they can shelter capital gains with a <a href=\"https:\/\/www.investopedia.com\/financial-edge\/0110\/10-things-to-know-about-1031-exchanges.aspx#:~:text=In%20real%20estate%2C%20a%201031,%2C%20investors%2C%20and%20soccer%20moms.\" target=\"_blank\" rel=\"noreferrer noopener\">1031 exchange<\/a>.  The <a href=\"https:\/\/en.wikipedia.org\/wiki\/Tax_Cuts_and_Jobs_Act_of_2017\" target=\"_blank\" rel=\"noreferrer noopener\">Tax Cuts and Jobs Act of 2017<\/a> introduced a significant benefit of a 20% pass through tax deduction for landlords.  This deduction enables landlords to deduct up to 20% of net rental income from income tax.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"what-is-the-20-pass-through-tax-deduction\">What is the 20% pass through tax deduction?<\/h2>\n\n\n\n<p>From 2018 through 2026, the 20% pass through tax deduction allows landlords to be taxed on 80% of rental net income.  Specifically, this deduction is only for <a href=\"https:\/\/www.fool.com\/the-blueprint\/pass-through-entity\/\" target=\"_blank\" rel=\"noreferrer noopener\">pass-through entities<\/a> where landlords run their rental business as a sole proprietor, LLC, or S corporation.  Overall, a pass-through entity is a <a href=\"https:\/\/www.nolo.com\/legal-encyclopedia\/landlords-must-be-in-business-to-claim-the-20-pass-through-tax-deduction.html\" target=\"_blank\" rel=\"noreferrer noopener\">common business type<\/a> where individuals pay their profits on their individual taxpayer rates.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"who-can-qualify\">Who can qualify?<\/h2>\n\n\n\n<p>T<a href=\"https:\/\/www.gfrlaw.com\/what-we-do\/insights\/landlords-should-get-active-and-seek-199a-safe-harbor#:~:text=Landlords%20Should%20Get%20Active%20and%20Seek%20the%20199A,and%20the%20taxpayer%20must%20have%20a%20profit%20motive.\" target=\"_blank\" rel=\"noreferrer noopener\">he IRS has a safe harbor rule<\/a> which simplifies the determination for how landlords can qualify for the tax deduction:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Maintain separate records to reflect the income and expenses for each rental real estate enterprise. <\/li><li>Perform 250 or more hours of rental services each year for each rental real estate enterprise. The safe harbor provides a list of rental services that qualify for this requirement.<\/li><li>Keep detailed records on the hours and descriptions of all services performed.<\/li><\/ol>\n\n\n\n<p>The amount landlords can deduct depends on <a href=\"https:\/\/www.stessa.com\/blog\/20-percent-pass-through-tax-deduction-faqs\/\" target=\"_blank\" rel=\"noreferrer noopener\">income qualifications<\/a>.  For example, landlords can deduct the full 20% if taxable income is less than $157,500 as a single filer or $315,000 if married filing jointly.  However, for higher income levels, a calculation will determine the deduction amount.  In other words, tax software or accounting professionals will need to perform the calculation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"to-qualify-keep-good-records\">To qualify, keep good records!<\/h2>\n\n\n\n<p>Well organized landlords track rental income and expenses, and good data helps landlords understand how well the rental business is doing.  In conclusion, the 20% pass through tax deduction for landlords and the safe harbor provisions to qualify reinforce the importance of good recordkeeping.  There are online tools that help track rental income and expenses.
